The late President Magsaysay
immortalized the saying “those who have less in life should have more in law”.
We should incorporate this in our legal system in the Philippines. If our
leaders would take the initiative, others will follow.
There are existing
differences in society, no doubt about that. According to Father Bernas, “the
equality guaranteed, however, is not a disembodied equality. It does not deny
to the state the power to recognize and act upon factual differences between
individuals and class”. We, like the law’s intention, should also realize that
poverty is one of those factual differences.
This stand does not give the
poor or the ones who have less in life a reason to feel weak or to abuse this
right or privilege. It is the opposite of that. This empowers them and gives
them hope. The hope that the laws have not forgotten them. Also, to show that
the makers of the legal system are behind the poor through the intention of the
law.
